Parliamentary Privilege Is Not Immunity from Lawful Inquiry – Speaker Bagbin Warns MPs

Accra, Ghana – In a decisive address marking the commencement of the second meeting of the Ninth Parliament, Speaker Alban Sumana Kingsford Bagbin underscored the limits of parliamentary privilege, asserting that it should not be misconstrued as immunity from lawful inquiry.

 It is not a license to disregard the law," Bagbin stated, emphasizing that the immunities granted to Parliament and its members are designed to protect the independence of the legislature, not to obstruct justice

Bagbin's remarks come amid an increase in official communications from law enforcement and investigative bodies directed at MPs. He acknowledged that some allegations pertain to actions before MPs assumed office, while others concern conduct during their tenure. Regardless, he stressed that such matters must be treated with the seriousness they deserve, as they directly impact the integrity of Parliament and public perception. 

The Speaker reaffirmed Parliament's commitment to upholding justice, stating, "Our position on this is nonnegotiable. Parliament will not stand by while members are subjected to unlawful or politically motivated persecution. But neither will Parliament offer protection to those who seek to misuse its privileges to frustrate legitimate investigations." 

Bagbin also addressed the broader responsibilities of MPs, urging them to rise above pettiness and prioritize national interest. He reminded lawmakers that the public expects ethical, purposeful, and proactive leadership, and that any failure to meet these expectations could erode confidence in democratic institutions

In conclusion, Speaker Bagbin's address serves as a clarion call for accountability and integrity within Ghana's legislative body, emphasizing that while parliamentary privileges exist to safeguard legislative independence, they should never be used as a shield against lawful scrutiny.
