Accra,

The Chief Ghana – The Ghana Bar Association (GBA), led by its National President Efua Ghartey, has publicly challenged the legality and broader implications of suspending Chief Justice Gertrude Torkornoo. Speaking during the 43rd anniversary of the Martyrs of the Rule of Law, Mrs. Ghartey expressed deep concern that the move “sets a poor precedent” for Ghana’s judiciary

.Justice was suspended on April 22, 2025, following petitions alleging misconduct and the initiation of a formal investigation. The GBA contends that the process lacks transparency, proper procedural adherence, and does not align with constitutional safeguards

“In the spirit of reconciliation… this act sets a poor precedent,” Ghartey stated during the event commemorating judges who were assassinated in 1982. She reminded the audience that the GBA’s advocacy is driven by principle—not personality—and that due process must be respected for all judicial officers

Ghartey also cautioned against politicising judicial discipline, noting that allowing such actions could open the door to repeated interference in the judiciary's work.

⚖️ Diverging Perspectives

The GBA’s stance contrasts sharply with that of government officials. Felix Kwakye Ofosu, Minister of State for Government Communications, defended the suspension as constitutionally compliant, stating that “President Mahama has acted in strict accordance with the Constitution… not extra‑constitutional”

In the accompanying video, President Ghartey elaborates on the threat this case poses to judicial autonomy and the need for protective safeguards moving forward.

???? Implications for Judicial Independence

Concern Details
Erosion of Independence The GBA warns that routinely suspending judges without exhausting due process alarms the legal community.
Slippery Slope Each case sets potential for future politicisation of judicial roles.
Constitutional Calls Ghartey urges the reconsideration of the suspension and emphasizes respect for constitutional rights.

???? What’s Next

The GBA is calling for the reversal of Chief Justice Torkornoo’s suspension, citing constitutional violations and institutional harm. The petitioning committees are expected to proceed with hearings, while public and legal scrutiny remains intense.
